This Privacy Policy (the “
Policy”) is effective as of the Effective Date written above (the “
Effective Date”) and describes how Spectrum Brands Canada, Inc. and its affiliated companies and subsidiaries (collectively, “Spectrum”, “we”, “us” or “our”) collect, use, disclose and otherwise process personal information about users of its websites, including smartbone, dreambone, glofish, furminator, goodnfunchews, matures-miracle, tetrafish, and blackanddeckerappliances that link to this Policy (each a “
Site”). Personal information is information about an identifiable individual.
This Policy only applies to information Spectrum collects from the Site and does not apply to any other business activity of Spectrum. By accessing and using the Site, you agree and consent to the collection, use and disclosure of your personal information by Spectrum for the purposes described in this Policy or that are otherwise explained to you at the time of collection. If you do not consent, you must leave the Site immediately.
Spectrum reserves the right to revise this Policy at any time. When we do, we will give you notice of the revised Policy by posting it on the Site and by updating the Effective Date at the top of the Policy. You are responsible for regularly reviewing the current Policy.
WHAT INFORMATION DO WE COLLECT AND HOW DO WE USE IT?
Personal Information
You may visit our Site without providing any personal information. However, in order to use certain Site features, you may be required to provide personal information.
For example, when you register with our Site, sign up for our newsletter, enter a sweepstakes, contest or other promotion, submit a rebate or coupon request, or communicate with us through our “Contact Us” page, we will collect your full name and contact information. We may also ask you to provide, or you may choose to provide, information about your hobbies, interests, product preferences and experiences, and past purchases. We use this information to manage and administer your online account, provide our newsletter and other information you request, respond to your inquiries, administer sweepstakes, contests and promotions, and process coupons and rebates.
Our Site may allow you to publicly post ratings, reviews, requests for advice, suggestions and testimonials (“
User Generate Content”). Please be aware that any User Generated Content you choose to provide will be associated with you (for example, through your username or other identifying information) and will be posted publicly and accessible to anyone. We may use User Generated Content and any associated identifying information for advertising and promotional purposes, to understand our customers’ experiences with our products, and for product improvement.
We may also use the personal information we collect for advertising, marketing and promotional purposes, including to send you information and offers by email, postal mail or otherwise regarding Spectrum’s products and services and the products and services of affiliated companies, for legitimate business purposes such as maintaining records and enforcing agreements, and for other purposes with your consent or as permitted or required by law.
Automatic Information
We may also collect certain information automatically when you visit the Site. “Automatic Information” is information automatically collected by our webserver (which may be hosted by a third party) or third-party services (such as Google Analytics) that your web browser automatically makes available whenever you visit our Site.
Automatic Information is not generally associated with personal information, but if it is, the Automatic Information will be treated as personal information.
We receive and store certain types of Automatic Information whenever you interact with us. This includes “HTML Cookies.” An “HTML Cookie” is a small amount of data that is sent to your browser from a webserver and stored on your computer’s hard drive. HTML Cookies provide a means for websites that you visit to keep track of your online patterns and preferences. Among other things, HTML Cookies help us identify returning users and customize our services to a user’s needs. By understanding which areas of the Site a user has visited, HTML Cookies allow us to present information, products, and specials that may be of the user’s interest.
Spectrum may also use “Flash Cookies,” which tracks a person's Internet use across multiple websites and are not deleted or controlled by users in the same manner as standard HTML Cookies.
In addition to HTML and Flash Cookies, our webserver automatically recognizes and/or collects (when possible) certain information, such as your domain name, IP address, type of computer, type of web browser, screen size and characteristics (e.g., color, resolution), operating system, and/or the city, province and country in which you are located. An “IP Address” is a number assigned to your computer when you connect to the Internet. We may also collect information regarding your Internet browsing history (e.g., the site you visited before accessing our Site, the search engine and search terms that you used, and information about your previous visits to our Site), the length of your visit, the pages you viewed, your Internet service provider, the language settings on your computer, and/or certain software (e.g., Java support).
We may use such Automatic Information for purposes of system administration, to improve the design and content of the Site, and/or to enable us to personalize your Internet experience. We may also use such information in the aggregate to analyze Site usage and/or to assess the traffic to the Site.

You may to opt-out of some Automatic Information collection through your web browser’s settings. However, doing so may disable many of the portions, features, or functionality of the Site. HOW DO WE SHARE THE INFORMATION WE COLLECT?
We may transfer or disclose personal information:
(a) To third parties (including affiliated companies and subsidiaries) that perform certain services on behalf of Spectrum, such as data hosting and processing, marketing and advertising, analytics, shipping, warranties, hiring practices, litigation matters, and governmental investigations.
(b) To third parties in connection with the sale or purchase of all or part of Spectrum or its business or assets for the purposes of evaluating and/or performing the proposed transaction. Assignees or successors of Spectrum or our business or assets may use and disclose your personal information for similar purposes as those described in this Policy.
(c) To meet any applicable law, regulation, legal process, or enforceable governmental request, to protect and defend the rights or property of Spectrum or its affiliated companies, to identify, contact, and/or bring legal action against someone who may have breached our Terms of Use, and/or to act to protect the interests of our Site, users, or others as we deem necessary.
IS THE INFORMATION COLLECTED SECURE?
We take reasonable steps to protect your personal information using physical, electronic or procedural security measures appropriate to the sensitivity of the information in our custody or control, which may include safeguards to protect against loss or theft, as well as unauthorized access, disclosure, copying, use or modification. Authorized employees, agents and mandataries of Spectrum who require access to your personal information in order to fulfil their job requirements will have access to your personal information. Despite these efforts, information transmitted on the Internet and/or stored on systems attached to the Internet is not 100% secure. As a result, we do not ensure, warrant, or guarantee the security or integrity of such information. We will not be responsible for disclosure of any information due to errors in transmission or the unauthorized acts of third parties.
CAN I ACCESS OR CORRECT MY PERSONAL INFORMATION?
The file containing your personal information will be maintained on Spectrum’s servers or those of its service providers. If you wish to request access to or correction of your personal information in our custody or control, you may write to us at the address below (see Contact Information). Your right to access or correct your personal information is subject to applicable legal restrictions. We may take reasonable steps to verify your identity before granting access or making corrections.
DO I HAVE ANY CHOICES REGARDING THE INFORMATION COLLECTED?
You may withdraw your consent to our collection, use and disclosure of your personal information at any time, subject to contractual and legal restrictions, and reasonable notice. If you withdraw your consent to certain uses or disclosures of your personal information, we may no longer be able to provide certain of our products or services. To withdraw your consent, please contact us as described below. To opt-out of our newsletter or other marketing communications, please look for the unsubscribe feature provided in the message or contact us as described below.
CHILDREN
Children under the age of 13 may not use or access Site without the consent and authorization of a parent or legal guardian. We do not intentionally gather information from children who are under the age of 13.
INTERNATIONAL DATA TRANSFERS
Spectrum and its service providers may be located outside of Canada, including in the United States, Mexico, Germany, or the United Kingdom. As a result, your personal information may be transferred to and processed in foreign jurisdictions. While outside of Canada, personal information will be subject to applicable foreign laws, which may permit government and national security agencies to access your personal information in certain circumstances.
CHANGES TO THIS PRIVACY POLICY
We reserve the right to revise this Policy at any time. When we do, we will give you notice of the revised Policy by posting it on the Site and by updating the Effective Date at the top of the Policy. You are responsible for regularly reviewing the current Policy. The most current version of the Policy may be reviewed by clicking on the “Privacy” or “Privacy Policy” hypertext located at the bottom of the Site. Your continued use of the Site after we post any revisions constitutes your agreement to any such revisions. If any such revisions are unacceptable to you, do not access the Site and do not submit any information to us.
LINKS TO OTHER WEBSITES
While you are using this Site, you may be linked or directed to other third-party sites outside of our Site that are beyond our control. Each of these third-party sites may have a privacy policy that differs from ours. For example, you might click on a link or banner advertisement that takes you off our Site.
